Assumpsit, on three promissory notes. A trial by the court resulted in a verdict for the plaintiff against the defendant, Thompson, and a verdict for the defendant, Stearns. During the course of the trial the defendant, Thompson, took no exceptions, made no motions, and filed no request for written findings of fact and rulings of law under P. L., c. 316, s. 12. After verdict, he filed four written exceptions to certain of the court's findings of fact, and two written exceptions to rulings of law made during the course of the trial.
